Welcome to Orchidy Terms and Conditions for use. These Terms and Conditions are the terms and conditions upon which Orchidy (we/us/our) make our website and catalogue, www.orchidy.co.uk and ‘Orchidy’, available to you and any of our services which are accessible on or via the Orchidy Site and Orchidy Service. These Terms and Conditions govern your use of the Orchidy Site and the Orchidy Service.

All Contracts between Orchidy and Members shall be governed by these Terms and Conditions, unless otherwise agreed in writing, and any variation to these Terms and Conditions shall have no effect unless expressly agreed in writing and signed by us.

By accepting our confirmation order either by email, fax, letter or verbal communication, you are intending to be bound your self by our Terms and Conditions contained in these terms and conditions and appearing anywhere on the Orchidy Site.

You: The customer with whom we make this agreement and includes a person who we reasonably believe is acting with your authority.

 

 

OUR ORCHIDS

1.

 

All our orchids are subject to availability and changes. Some orchids will be subject to seasonal changes. In the event of any supply difficulties or your selection is not available. We will inform you as quick as possible and reserve the right to substitute a similar range or an equal value and quality.

     

2.

 

Our Special Offer Orchid(s) is/are subject to availability and seasonal change, depend on their season.

     

3.

 

We reserve the right to reject any order without giving any reasons. In the event of rejection, we will refund via reasonable payment method or cancel any payment received via the payment method used to place an order.

     

4.

 

In the event that we are unable to supply all or part of your order the orchid or any substitute orchid to you at all, for any reason, we shall inform you as soon as possible and make repayment to you in full no later than 30 days after the intended delivery date..

     

5.

 

All our orchids as shown on our website, www.orchidy.co.uk and our catalogue ‘Orchidy’, and as may perhaps be varied from time to time, are available in the Manchester Area (BL /M /OL /SK / WA /WN). See more details on Shipment & Delivery (click and go to Shipment & Delivery 7-8).

     

6.

 

To maximize their freshness, our farmers normally cut orchids in the morning of the date of dispatch and all orchids will be under the process of cleaning, packing and get ready to be transported to you. Normally all processes take about 10-48 hours (GMT+ 6 hrs) from cutting to dispatching. Subject to unexpected event, should you expect this period of time to be longer.

     

7.

 

We guarantee the freshness of our orchids for 7 days. They are long lasting and can last from 7 days to 3 weeks subject to a proper care and nature of particular orchid.

     

8.

 

After their long journey, the orchids need only a simple, refreshing drink. Simply revive them by following our

cut orchid care instructions.

     

9.

 

Please bear in mind, some case, some orchids may cause an allergic reaction to some people.

     

10.

 

Apart from the orchids shown on our website and in our catalogue, if you have any particular requirement regarding orchid types or you are looking for specific orchid(s), including other special tropical flowers and foliage, please give us at least a week notice in advance by writing to us at info@orchidy.co.uk. We will try our best to fulfil your requirement..

     

11.

 

All photographs are provided for guidance only and all sizes given are a guide measurement.

     

 

HOW TO ORDER & PAYMENT

1.

 

Order unit = Tray

     

2.

 

One Tray contains one of the following;

 

- 6 bunches for Orchid, which are type ‘D’, ‘M’ ‘S' and ‘L’; or

- 6 bunches for Others; Others, which is type ‘O’; or

- 6 bunches for Others; Heliconia and Foliage, which is type ‘H’; or

- 5 bunches for Others; Water Lily and Lotus, which is type ‘W’; or

- 2 bunches for Others; Anthurium, which is type ‘A’.

     

3.

 

Portion of stems per bunch is vary in number as it depends on type of the flower. Details are shown on our Price List and Order Form.

     

4.

 

The orchids outlined on our website and in our catalogue can be ordered using the order form, email your order and details, or by calling us on 0161 834 1259.

     

5.

 

Please give us at least a week notice in advance before your desired arrival date, to make sure that we will find the most beautiful and appropriate orchids for you.

     

6.

 

Our farmers normally cut orchids every weekend (GMT+ 6 hrs). In order to reduce waiting time, we recommend ordering on Friday from 8 am – 6 pm.

     

7.

 

To place an order please have orchid name or code and order unit (tray) handy, complete the order form and send to us at order@orchidy.co.uk or fax on 0161 834 1259. Alternatively, email your order and your details, including address and contact number, to us at order@orchidy.co.uk or call us on 0161 834 1259.

     
     

8.

 

Payment should be made once you receive an invoice and can be made by Debit/Credit Cards, BACS or paying in.

We accept all major debit and credit cards. Payment by debit/credit cards will be made via Paypal through our electronic invoice. Should you be informed that 3.0% charge will be applied to any order for credit card and debit card payment.

     

11.

 

Placing your order is subject to our acceptance. Once an order has been received, we will confirm the order, in writing either email or fax or with verbal communication, to confirm your order details and that we are processing your order. Please carefully check that all details are correctt.

     

12.

 

From this time you will have the opportunity to approve, amend or cancel the order by respond our confirmation email or fax within 24 hours of receiving confirmation order. Once you approve the confirmation order or if no amendment or cancellation is taken, it shall be deemed that the order is correct; once this is done you are fully liable for the full value order and any costs incurred.

We reserve the right to cancel your order in any case if there is no respond from you within a reasonable period of time where we see fit.

     

14.

 

We must receive full payment of invoice before the order can be accepted and are assigned to production. Once payment has been received by us, we will confirm that your order has been accepted by sending an email to you at email address provided on order form. Our acceptance of your order brings into existence a legally binding contract between us.

     

15.

 

All payments should be made once you receive an invoice, or all invoices are due for payment strictly within 48 hours from the date of invoice in which such an invoice was emailed or faxed to you, or we shall receive all payments by or within the date give on an invoice.

     

16.

 

If we do not receive your payment by or within the date given, or any invoice not paid within this time, the late payment interest will be incurred under the Late Payment of Commercial Debts (Interest) Act 1998. Under the revised legislation, the late payment interest rate that will apply to you is the reference rate + eight per cent. The late payment interest invoice will be sending to you or will be added to the unpaid Invoice Total. Regard to the late payment matter, we may use the third party and payment of interest must be under rules of payment which stated in the Clause 16 above, in this Section. Any charges incurred Orchidy, whilst in pursuit of any overdue invoice shall be borne by the customer concerned. The cost of any legal action that involves outstanding accounts will be charged to the customer. All charges are subject to VAT at the current rate.

     

17.

 

IIf you make a payment by BACS or internet banking, please ensure you quote the payment reference: your order number, which can be found in our confirmation order, when making payments. Once you have made your payment, please inform us your payment reference by email at order@orchidy.co.uk, call or fax us on 0161 834 1259. If you provide us an incorrect receipt or order number, including ignore or forget to do so, the process of your order might be delayed.

     

18.

 

We will ask for your proof of payment if you make a payment by paying in at your local branch to Orchidy account. Once you have made your payment, please ensure you send us a copy of receipt with your order number stated on top. Email to us at order@orchidy.co.uk or fax on 0161 834 1259. If you provide us an incorrect receipt or order number, including ignore or forget to do so, the process of your order might be delayed.

     

19.

 

After we have received your approval, along with proof of payment, your order will be processed and being assigned to production.

Price list from us are valid for a maximum of 14 days of submitting your order form.

     

2.

 

All prices shown are a price per bunch excluding VAT.

     

3.

 

All prices shown are excluding delivery service charge if applicable, please see more details on Delivery & Shipment.

     

4.

5.

 

Standard price subject to seasonal change. We reserve the right to regulate price of all our orchids due to orchid flowers market and to offer you the best prices possible.

     

6.

 

Special offer orchid price(s) subject to seasonal change and availability.

     

7.

 

We reserve the right to regulate price of all our orchids and delivery charges subject to peak season such as Mothers day, Valentine, Christmas, Easter and selected special events.

     

 

 

DELIVERY & SHIPMENT

1.

 

After your order has been approved and placed with our team in Thailand, your orchids will be selected and hand-cut, cleaned, packed and then transported direct to the UK.

     

2.

 

Normally our orchids will be dispatched from Suvarnabhumi Airport in late evening and should be arrived in the UK in the following morning. Due to the flight availability is vary, we can not guarantee the specific time of orchids dispatch from Thailand but we do our best to ensure that you will receive them on reasonable time.

     

3.

 

As we recommend ordering on Friday from 8 am – 6 pm. You will receive orchids normally within 10 working days after the date ordered, due to quality standard of our orchids and we only select the most beautiful stems for you. Subject to any supply difficulties or your orchids are not available, we will inform you and should you expect this period of time to be longer.

     

4.

 

We will notify you in writing either email or fax or with verbal communication once they were dispatched from Thailand.

     

5.

 

Once they arrive to the UK, they will be delivered direct to you in the same day by national professional courier during normal working hours (9 am – 5 pm) Monday to Friday excluding Bank Holidays. Time of delivery can not be specific but in special cases should you please inform us in advance for preferable time.

     

6.

 

Delivery service within Manchester area postcodes ‘M’ and ‘SK1’ to ‘SK4’ are free of charge.

     

7.

 

For ‘BL’, ‘OL’, ‘SK5-23’, ‘WA’ and ‘WN’ postcodes, we provide free delivery service with particular minimum order or delivery charges are vary depend on postcodes as follow;

‘SK5 to SK9’ and ‘OL1 to OL9’ postcodes: delivery service charge is £3, free delivery for order with minimum 2 trays.

‘SK10 to SK16’ postcodes: delivery service charge is £5, free delivery for order with minimum 2 trays.

‘SK13-17-22-23’ and ‘BL’ postcodes: delivery service charge is £10, free delivery for order with minimum 3 trays.

‘OL10 to OL16’ postcodes: delivery service charge is £13, free delivery for order with minimum 4 trays.

‘WA’ postcodes: delivery service charge is £15, free delivery for order with minimum 4 trays.

‘WN’ postcodes: delivery service charge is £20, free delivery for order with minimum 5 trays.

 

     

8.

 

If you are not in the postcode areas stated and you are interested in our orchids or have any enquiry regard to our delivery service, please let us know or contact us for more information at info@orchidy.co.uk or call us on 0161 834 1259.

     

9.

 

We reserve the right to amend areas of our delivery service without any notice

     

10.

 

Apart from peak season such as Mothers day, Valentine, Christmas, Easter and selected special events, delivery is not available on Weekend and public holidays; due to reduce your waiting time and maximize freshness of orchids. Delivery on peak season may cause a premium charge subject to availability.

     

11.

 

To avoid any problem occurs or delay of delivery, please ensure that you have included the full correct details, including accurate address and postcode of yours or  the intended recipient, contact number, together with your daytime contact telephone or mobile number and email address so we can inform you if particular situation, any problem or delayed delivery has been occurred.

     

12.

 

Please ensure that someone is available at the delivery address to sign for the orchids. If you or your recipients are not able to accept your purchase or the courier can not find someone to accept delivery, they will leave a card at the address you provided. Should you or your recipient make a contact for rearrange delivery and we reserve the right to charge for consequence of re-delivery. Please be aware these will cause freshness of orchids.

     

13.

 

None acceptance of delivery, does not release the customer from any charges due for those orchids, delivery and return delivery.

     

14.

 

We are not responsible for non-receipt of orchids if incorrect address provided, or no recipient, or the intended recipient is not at the address provided, or the recipient refuses the orchids.

     

15.

 

We cannot be held responsible for late delivery which beyond our control. However, in some particular circumstances we will try our best to apply for part or full repayment based on the damage caused by late delivery but the repayment will not exceed the value of your order.

     

16.

 

We cannot be held responsible for late delivery due to logistic problems within 2 days after the expected delivery date. After this period you may apply for partly or full repayment based on the damage caused by the late delivery. In unexpected circumstance control and orchids are delivered late, you or your recipient should not refuse the package(s).

     

17.

 

In the case that beyond our reasonable control. We will contact you in advance as soon as possible to rearrange delivery. .

     

18.

 

We do not recommend courier deliveries to a third party for instance hospitals, airport, office etc. If you require your order to be delivered to a third party, the signature of any person authorised to accept delivery on behalf of you shall be accepted as proof of delivery to your chosen recipient.

     

 

 

ORDER CANCELLATION & AMENDMENT

1.

 

Amendment can be accepted. If you would like to change or make any change to your order, you can reply to our confirmation order, please state ‘Amendment’ and details of your amendment. Alternatively, inform us at order@orchidyco.uk, call or fax us on 0161 834 1259. Amendment has to be made within 24 hours of receiving our confirmation of your order details. However, afterward, if you would like to make any change to your order, please be informed that it might cause a delay.

     

2.

 

Cancellation can be accepted. If you would like to cancel your order, you can reply to our confirmation order or inform us at order@orchidyco.uk. Alternatively, call or fax us on 0161 834 1259. Cancellation has to be made within 24 hours of receiving our confirmation of your order details.

     

3.

 

We regret that we can not accept cancellation of any order or you may not change the order once the order has been placed with our team in Thailand or they are assigned to production.

     

4.

 

We shall not be held liable for any loses suffered in the event of Orchidy cancelling an order due to events beyond their control.

     

5.

 

If cancellation has been success, we will refund as soon as possible and in any event within 30 days of your order via reasonable payment method or cancel any payment received via the payment method used to place an order.

     

6.

 

In peak season such as Mothers day, Valentine, Christmas, Easter and selected special events. We cannot guarantee to cancel or make any changes to the order.

     

 

SATISFACTION GUARANTEED & DAMAGED ORCHIDS

1.

 

Your pleasure is our business and we are also keeping serving you a very high standard of service. We always do our best to ensure this does not occur but if orchids are damaged by reason of transportation or unexpected cause by us or if you are not satisfied with your orchid, even a single stem, which is caused from freshness and quality, please inform us once you received within the same day and also send us an evidence of the damage such as pictures of damaged orchids.

     

2.

 

Due to the perishable nature of orchid all orchids should be checked immediately upon receipt and we should be advised of any damaged orchids received immediately. if you are not able to inform and send us evidences of the damage with in the same day of receiving, we can not guarantee for resend new orchid(s). Regarding damaged orchid matters please contact us at info@orchidy.co.uk or fax to 0161 834 1259.

     

3.

 

Until we make collection, at the time the claim is made the orchids must be stored according to the orchid care instruction. No part of the claimed damaged orchids may be used, sold or destroyed, without prior authorisation from us.

     

4.

 

We will investigate and after the decision has been made; we will then resend them on the next available delivery date or reserve all rights to refuse the option of resending the order. The guarantee does not comply the right to an automatic fully resend, but only to a reasonable resolution. We also reserve all rights to ask for damaged orchids to be returned and should you responsible for delivery cost of return those orchids.

     

5.

 

If you are not completely satisfied with the orchids received from us regarding freshness and quality, we will redeliver, resend or offer a comparable replacement if the original orchids are not available.

     

6.

 

Apart from resend the orchid(s) cause of damaged we regret that we can not make a refund due to the perishable nature of orchid.

     

7.

 

We reserve all rights to refuse to take and/or not to resend orders from particular customer if we consider that there has been mistreated of satisfaction guaranteed policy.

     

8.

 

We will inform you the decision in writing either by email, fax, post or verbal communication by phone.

     

 

MEMBERSHIP


Membership Agreement means the Agreement executed by Orchidy and the applicant through which the successful

applicant becomes the Member of Orchidy. Membership Agreement shall be governed by these Terms and Conditions.

If you are not satisfied with your order or our services provided, please inform us at info@orchidy.co.uk. We are please to listen and improve our service to meet your requirements.

     

 

COMPLAIN

1.

 

If, in any reason, that you are not satisfied with our orchids or service any complaints should be addressed in the first instance. Please write and send to us at info@orchidy.co.uk, fax on 0161 834 1259 or post to Orchidy, 202 Jefferson Place, 1 Fernie Street, Manchester, M4 4AZ. We are available from 8am - 5pm Monday to Friday.

     

2.

 

Due to the perishable nature of orchid and to help us solve your complaint quicker. We recommend you to make a complaint within the same day of the receiving date or delivery accepted date.

     

 

DISCLAIMER

 

1.

 

Whilst we agree to use all reasonable endeavours to ensure that Orchidy Site and/or Orchidy Service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of Orchidy Site and/or Orchidy Service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of Orchidy Site and/or Orchidy Service impossible or impractical.

     

2.

 

We exclude all liability for any claims, losses, damages and demands, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access Orchidy Site and/or Orchidy Service, whether arising in contract, tort (including negligence), under statute or otherwise provided that nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the products supplied.

Subject to clauses 3 in ‘Our Orchids’ above, we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.

     

 

 

SECURITY / PRIVACY POLICY / COOKIES

Orchidy recognize and respect the importance of maintaining the privacy of our customers and have established this privacy policy as a result.

We will record your personal details if you send us an enquiry. To keep in touch with you and get feedback about our orchids and services. We may use your details to send you further information on Orchidy branded orchids and service, to keep you up to date on our orchids and services, special offers and new collections you might be interested in. If you prefer not to receive such information or prefer to remove your details, please write to us at info@orchidy.co.uk.

We never give, rent and sell our Email list or your private information to the third party.

We will take reasonable managerial and technical protection to avoid mistreatment, loss or change of your personal details and information.

We will post any changes on Orchidy Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access Orchidy Site and/or Orchidy Service. Changes will be effective five hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions. Should you check this page occasionally to ensure you are pleased with any change. We may also notify you of changes to our terms and conditions by email.

We reserve all rights to suspend, restrict or terminate access to Orchidy Site and/or Orchidy Service for any reason at any time.

These Terms and Conditions shall be deemed to include all other policies, notices, disclaimers and other terms contained in Orchidy Site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail unless otherwise agreed to in writing by Orchidy. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

We shall make sure that we meet the terms with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.

A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act. .

In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

     

 

INTELLECTUAL PROPERTY RIGHTS

Our Trade Marks, both registered and unregistered, and logos must not be used or adapted in any way without obtaining the permission of Orchidy. Dissemination and copying of materials within Orchidy Site or Orchidy Catalogue is strictly prohibited without prior written consent from us.

Products, technology, website and processes which are contained in this web site, www.orchidy.co.uk, may be the subject of other intellectual property rights owned by Orchidy or by third parties. No licence is granted in respect of those intellectual property rights other than as set out in these Terms. Your use of this website, www.orchidy.co.uk, must not in any way infringe the intellectual property rights of any person.
